REGULAR BOARD MEETING

Chairman Martin called the meeting to order at 10:00 A.M. and appointed Shelby Smith scribe.
APPROVAL OF MINUTES
Director Putnam made a motion to approve the minutes of the October 12, 2004, 2004 Regular Board Meeting and October 12, 2004 Executive Board Meeting, with a correction to the minutes of the Executive Board Meeting, seconded by Vice-Chairman Morrow, motion carried unanimously.
APPROVAL OF VOUCHER LIST
Director Putnam made a motion that the November 2004 Voucher List be approved, seconded by Director Schlueter, motion carried unanimously.
CRESCENT LAKE WATER REPORT
Manager McDaniels said that Crescent Lake has 28,092 acre-feet.
GERKING FLUME
At the October 12, 2004 Regular Board Meeting, the Board moved to replace the Gerking Flume with underground pipe. Director Blake said he was concerned that pulling the flume down might create a public relations nightmare. He said that several people in the District would like to see the flume restored, and are interested in discussing ways to raise money for that purpose. Restoring the flume would not relieve the District of liability, unless the District was legally relieved of liability. Also, it would not satisfy the County, who wants the flume out of its right-of-way. Moving the flume to another location might be an option. Manager McDaniels and Director Blake will set up a meeting with interested parties to explain the conservation, financial, and safety issues involved.
COMMISSIONERS HEARING OCTOBER 13, 2004, SIZEMORE RD.
Manager McDaniels and Attorney Hopp attended this meeting. The Commissioners approved legally taking over Sizemore Rd. south of Tumalo Reservoir Rd. Attorney Hopp said that during this process, the County found that there was a dedication to the public that went out into the property the District got from the State of Oregon. They abandoned that right-of-way in accepting this one. That consolidates the District’s holdings in that area, and makes the wildlife protected area more secure. Ann Cobb needs to apply for a lot line adjustment.

TUMALO FEED DAM STUDY
Kevin Crew had an expert inspect the Tumalo Feed Dam, and do some core samples. The samples showed that the dam is gravel pushed up with concrete over the top. He saw no red flags that would indicate immediate problems. The Tumalo Feed Dam and headgate are listed as historic features. The documents say that a plan must be submitted before these structures can be modified. Since the design for the fish screen and ladder will affect these structures, including removing the headgate, Mr. Crew will meet with the State Historic Preservation Office to try to get the design approved.
The Steidel Dam is a more expensive proposition to maintain or replace. He said that are no obvious signs of immediate problems, but there are some maintenance issues that need to be addressed.
LETTER TO USBR FROM KYLE GORMAN, HYDROMET
See attached copy of letter from Kyle Gorman, Oregon Water Resources Department, to Leo Busch, Bureau of Reclamation, dated October 12, 2004, thanking the Bureau for its efforts in upgrading and maintaining the hydromet system in this region.
OWRC ANNUAL MEETING DECEMBER 1 – 3, 2004
Manager McDaniels and Attorney Hopp will attend this meeting in Hood River. The Board was invited to attend.
DESCHUTES RESOURCES CONSERVANCY GRANT APPLICATION FOR GERKING FLUME
Manager McDaniels said he and Mr. Crew have applied to DRC for a $33,000 grant to replace the Gerking Flume.
BEND FEED CANAL PROJECT, SECTION #5
Manager McDaniels said Weekly Brothers has started the last section of the Bend Feed Canal. They will not complete the project until after the first of the year.

According to Ken Rieck, there is no jeopardy water this year.

CONSERVED WATER POLICY
See attached copy of draft of conserved water allocation policy, prepared by Attorney Hopp. He said that the Oregon Water Resources Department has adopted Administrative Rules dealing with conserved water. One of the rules is that each district must adopt a policy, regarding how it will deal with conserved water in the future. This policy must be discussed and adopted at a public meeting. Attorney Hopp suggested that notice of the meeting be given by newsletter, a legal notice in the Bulletin, and on the office reader board. The public must be notified of any future project that involves conserved water.

The next Regular Board Meeting will be Tuesday, December 14, 2004, at 10:00 A.M., at the District Office.

Barbara Heisler’s account is delinquent. Notice of Right to Lien has been filed. Director Putnam made a motion that Attorney Hopp proceed with foreclosure, seconded by Director Blake, motion carried unanimously.

Director Putnam made a motion that the Regular Board Meeting be adjourned at 12:20 P.M., seconded by Director Schlueter, motion carried unanimously.
