Chairman Martin called the meeting to order at 10:00 A.M. and appointed Shelby Smith scribe. 

 

APPROVAL OF MINUTES

 

Director Putnam made a motion that the minutes of the January 15, 2002 Annual/Regular Board Meeting and January 15, 2002 Executive Board Meeting be approved, seconded by Vice-Chairman Morrow, motion carried unanimously.  

 

APPROVAL OF VOUCHER LIST

 

Vice-Chairman Morrow made a motion that the February 2002 Voucher List be approved, seconded by Director Putnam, motion carried unanimously.

 

CRESCENT LAKE WATER REPORT

 

No report available. 

 

FLUME #4 UPDATE

 

The contractor is waiting for the frost to get out of the ground before he backfills around the inlet and outlet structures. 

 

PROJECT 3B UPDATE

 

According to Manager McDaniels, the project is on schedule.

 

REPORT ON WATER RESOURCES COMMISSION MEETING

 

Manager McDaniels and the District received two awards at the Water Resources Commission Meeting in Salem, one from Governor John A. Kitzhaber, and one from the Oregon Water Resources Commission.

 

SUBURBAN ACCIDENT

 

A vehicle backing out of a parking lot hit the passenger side of the Suburban.  Damage to front door, rear door, and rear quarter panel on passenger side.  The other driver’s insurance, State Farm, is paying all repair costs plus vehicle rental while the Suburban is in the body shop. 

 

On the trip back from Salem, a tree limb went through the windshield.

DESCHUTES RESOURCES CONSERVANCY, RAY HARTWELL

 

See attached copy of Ray Hartwell’s memo dated January 31, 2002.  Mr. Hartwell explained that the Deschutes Resources Conservancy’s Board of Directors has approved a program to compensate water rights holders for leasing their water instream.  In this District, for 2002, the compensation would be $23.00 an acre, up to $12,000.  This dollar amount is based on the District’s total water leased instream in 2001.  This year’s compensation is based on last year’s total, which means that the lessors this year get the benefit of last year’s lessors.  Mr. Hartwell said that is the only practical way the DRC could determine the compensation.  The District will receive a check after the Pooled Lease is submitted to the OWRD, which we will disburse to this year’s lessors, based on the number acres they leased.  Since the District did not have this information in time to include in the January newsletter, Ms. Smith expressed concern that people who did not lease might object, because they were not notified that they would be compensated if they leased.  Compensation will be a windfall for those who lease this year. 

              

Manager McDaniels said that Ron Nelson, as Chairman of the DRC, has made a request to all districts to contribute $300 each to DRC for expenses for travel, DC trips, etc.  Director Putnam made a motion that the District contribute $300 to DRC, seconded by Vice-Chairman Morrow, motion carried unanimously.

 

NOTICE OF COMMISSION HEARING FEBRUARY 13, 2002

 

Deschutes County is considering an ordinance which will require applicants for a building permit within the boundaries of a water district to obtain water service from the district or obtain district approval to use another water source.  A sentence that states, “Upon notice of violation of the state and federal regulations regarding water supply domestic use not covered under paragraph B, above, the County shall notify the appropriate irrigation district”, is of concern to the District, because we have no authority to deal with the problem.  Manager McDaniels will comment on this at the hearing.

WATER TRANSFER

Ms. Smith said interest holders have not responded with releases yet.  Director Putnam made a motion that these transfers be approved, with the contingency that the releases are obtained, seconded by Vice-Chairman Morrow, motion carried unanimously.

SAFE DRINKING WATER ACT

 

Manager McDaniels asked if we should be notifying mortgage holders on properties with cisterns.  Attorney Hopp said they would have no interest in participating in the problem, and they could do nothing about it anyway.  Ms. Smith said the only reason they might become involved is if the District cuts off irrigation water to the property.

The next Regular Board Meeting will be Tuesday, March 12, 2002, at 10:00 A.M., in the District office.

Vice-Chairman Morrow made a motion that the Regular Board Meeting be adjourned at 11:00 A.M., seconded by Director Putnam, motion carried unanimously.
